Our practice includes the formation of partnerships, corporations and limited liability companies. We also provide ongoing advice and litigation services concerning the many legal issues facing all kinds of modern businesses including, contracts, negotiations, general business disputes, and licensing needs (just to name few).
Today's business organizations are increasingly complex. We understand these intricacies and can guide you through them. Our areas of expertise include shareholder and operating agreements, negotiation of contracts and leases, corporate governance, representation of lenders and borrowers, partnership and shareholder disputes, and representation of creditors in bankruptcy and other contexts.
Although we also counsel our clients on how to avoid litigation if possible, Frederic C. Goetz, Esq., LLC handles all types of general and commercial litigation in state and federal courts, ranging from simple contractual matters to complex questions of law. We will explore all options, analyzing costs and merits of particular actions, explore dispute resolution and advise you such that you can make your own informed decisions. Unintentional infractions with the law are not uncommon. If it happens, we will be there to help you through those tough times. Frederic C. Goetz, Esq., LLC has extensive municipal court experience defending motorists accused of traffic offenses, and DUI. Our criminal and municipal practice also includes theft related offenses, assault and battery, DWI, drug offenses, and juvenile offenses.
Dealing with your estate can often be trying and complicated time. Our attorneys are experienced in addressing special concerns, such as succession in family-owned businesses, preparation of trusts and wills, living wills, structuring gift giving and planning for the disposition of insurance proceeds.
We also handle probate and estate administration. Probate is the legal process by which a person's Will is allowed by the Probate Court. The provisions of the will dictate how the individual's debts are paid an assets are distributed upon death. Estate administration includes the probate process as well as non-probate transfers of deceased's assets, such as life insurance, annuities, qualified plans, and trust assets and compliance with applicable estate tax requirement. We assist the personal representative of the estate in the gathering, valuation, accounting and distribution of the decedent assets. We also ensure that all steps are properly taken in order to carry out the decedent's intent in accordance with the law.
In circumstances where disputes arise after a death, our office can assist in will contest litigation. We offer representation to the Estate or estate representative (i.e. administrator or executor), or to individuals challenging the validity of a will or the way the administrator is carrying out his or her duties.
Getting the site plan approvals, subdivision plan approvals and variances are difficult and time-consuming processes. It requires that a property owner provide public notice of a proposed use and obtain a variance from government agencies that oversee the enforcement of municipal zoning plans. The process customarily requires a public hearing on the proposed use variance and opposition to zoning changes by neighbors and other interested parties can be fierce.
Our goal in every land use matter is to streamline the process and anticipate potential challenges. From bars and restaurants to parking spaces and multi-million dollar developments, we have the experience and knowledge to represent your best interests and maximize the value of your real estate.
